1.1: Use of commissioned works in AI models and LoRAs is now permitted, and derivative works made with AI are also permitted. Added "Views expressed by commissioners and derivative works do not necessarily reflect the views of the artist" clause to the end.
- I will not draw NSFW works, crudity, lewdity, cartoon nudity, fetish and fetish-adjacent works, gore, and violence. Don't ask for it.
- I do not accept NSFW references and modelsheets. Anyone who sends one will be refunded. (If such a sheet is all you have, censor it in your favorite art software to at least a cartoon nudity level before submitting it.)
- I only draw romantic situations between ontological male and ontological female characters who are either dating, engaged, or married.
- No genderswaps. Ontologically male characters will be drawn male, and ontologically female characters will be drawn female.
- Patriotism is acceptable (American flags, flags of your country, etc.), but I draw the line on political issues there. I try to keep political ideologies of either 'wing' away from my artwork so everyone can enjoy it.
- I reserve the right to dismiss and refund any commission at my discretion for any reason unstated here. I also reserve the right to change or modify these terms at any time, for any reason. Whichever version of these terms of service was active at the time you purchased an item or commission is the version that is binding for that transaction. (I won't retroactively apply changes mid-project. That's a pain for both of us.) Check the date at the top of this page to see when the TOS was last modified.
I retain full copyright to all artwork I draw and reserve the right to post it to social media, personal websites, imageboards, convention booths, and anywhere else art might be displayed for advertisement and promotional purposes. I also reserve the right to resell copies of and products based on the original artwork, such as prints or stickers.
If you have purchased art of your own characters:
- You have full display rights -- post it anywhere, on anything, with anybody.
- You have full reproduction and distribution rights -- print a poster, put it on a T-shirt, study it in class.
- You have full sales rights -- if you do print a poster or make a T-shirt, you can sell it.
- You have full rights to make derivative works -- paint over it, put it in a game, use it in a modern art installation.
- You may include the work as training data for an AI dataset, model, or LoRA, and you may use the work as a starting point for inpainting or derivative works made with AI.
- You may not use the artwork to create a non-fungible token or other blockchain-based product currently in existence or created in the future.
Attribution is required for commercial use (such as T-shirts) and requested for personal use (such as a post on social media or your website.) The in-image signature is plenty.
If you have purchased a 'group commission' with other characters, all character owners have the same rights listed above. NOTE: This includes commercial rights -- please specify "no commercial use" if one of the owners would disapprove of their IP appearing on a T-shirt another rightsholder of the commission made!
Gifting commissions is allowed, provided that the character owner permits fanart/giftart or gives their express permission. (Sending a link to where this permission is found is appreciated.) In these cases, all rights are given to the recipient(s) of the artwork and not the commissioner.
I will send a message with details and possibly a scan or project file of your commission as it moves through the following phases:
Preliminary sketch
- Scanned work or .PNG export included.
- Sketch commissions will include a 1200DPI 16-bit grayscale scan of the work
- Other commissions require approval to continue. This is the last opportunity to use a free change order.
Ink
- Scanned work or .PNG export included.
- Last opportunity to change anything. Changes incur additional cost.
Color
- 1200DPI, 24-bit .TIF or upscaled .PNG export included.
- Finalized commissions.
- The owner of the artwork receives permanently transferable rights to display, resell, modify, and make copies of the original.
- I retain the copyright to all pieces.
- Commissions will likely be delivered somewhere within the time frame of 'two days' to 'two months,' depending on the complexity of the work and my schedule. I will send periodic progress updates as well as notifications of any delay to either your Ko-fi account or your linked Twitter/Discord account.
- Traditional commissions receive one free edit request at the sketch approval stage. Edits and change orders during the inking phase will incur an additional charge equal to 30% of the original commission price. No edits or changes are offered after the piece moves to the color phase.
- Pixel commissions receive one free edit request at the flat color/formsketch phase, unless otherwise noted. Additional edits may incur an additional charge up to 25% of the original commission price.
- Payment is due up front and in full on Ko-fi, and no refunds or returns are offered unless I am unable to complete the commission or order in a timely manner due to extenuating circumstances.
- Views expressed by commissioners and derivative works do not necessarily reflect the views of the artist.
